Terms of Use for TenderDexta Learning Management System (LMS)

These Terms and Conditions ("Terms") govern your access to and use of the TenderDexta Learning Management System (LMS) operated by Baritex International Services Limited, a company duly registered under the laws of the Federal Republic of Nigeria. By accessing or using any part of the platform, you accept and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our services.

1. Definitions

• "TenderDexta" means the LMS owned and operated by Baritex International Services Limited.
• "User" or "Learner" refers to any individual who registers, enrolls in, or participates in any course.
• "Instructor" refers to any individual or entity that creates and delivers content on the LMS.
• "Services" refer to all offerings, tools, and functions on the platform.
• "Content" refers to all course materials and related intellectual property.

2. Scope of Services

TenderDexta offers online courses across disciplines, created by Baritex or third-party instructors. Users may access free or paid content, take assessments, and receive certificates.

3. User Registration and Account Management

• Create an account with accurate and complete details.
• Maintain confidentiality of login credentials.
• Unauthorized use must be reported immediately.
• We reserve the right to suspend or terminate violating accounts.
• Personal info including profile picture and experience is subject to our Privacy Policy.

4. Course Access, Assessments, and Certification

• Access is granted post enrollment/payment for personal use.
• Assessment results are delivered electronically.
• Certificates are issued after successful course completion.
• TenderDexta defines grading and passing criteria.

5. Payments and Transactions

• Course fees are subject to change and must be paid upfront.
• Payment grants a limited license to access materials.
• Payments are handled via licensed third-party processors.
• We are not liable for third-party payment failures.

6. Refunds and Cancellations

• Refunds must be requested within 7 days of enrollment.
• Refunds are subject to case-by-case assessment.
• No refunds after certificate issuance or extensive use of materials.

7. Instructor Participation and Agreements

• Instructors must sign a separate agreement.
• They retain content ownership but grant TenderDexta license to use it.
• We may remove content violating guidelines.

8. User Conduct

Users agree not to:

• Violate any laws
• Infringe intellectual property rights
• Spam or harass others
• Bypass access controls

Violations may lead to account suspension or termination without refund.

9. Intellectual Property

• All platform materials are owned by Baritex or its contributors.
• Reproduction/distribution is strictly prohibited.

10. Data Protection

• All data is processed according to our Privacy Policy.
• Use of the platform implies consent to data collection and use.
• Instructors may access limited data for academic purposes only.
• International users consent to data storage in Nigeria or other necessary jurisdictions.

11. Modifications

We may update these Terms. Major changes will be communicated. Continued use means acceptance of changes.

12. Governing Law and Dispute Resolution

These Terms are governed by Nigerian law. Disputes shall be resolved amicably or via arbitration in Lagos under the Arbitration and Conciliation Act.
